But what we’re being fed right now by the state’s lapdog–corporate media, is saccharine sweet to keep some of us placated, ultra sour to keep others of us divided, and 100% rotting us from the inside. This steady diet of nothing keeps most of us distracted from the hammer held above our heads, just out of sight, ready to fall when we step out of line. For those who refuse the distraction, who face the full brunt of state repression, NYC ABC and Page One Collective again come together to show support. Please join us this week in writing letters to water protector and grand jury resister Steve Martinez.

Steve Martinez, an Indigenous and Chicano activist who participated in the protests against the Dakota Access Pipeline (DAPL) on the Standing Rock reservation in North Dakota in 2016, is being held on charges of contempt of court for refusing to testify before a federal grand jury.

Steve invoked the Fifth Amendment in an effort to avoid participation in the grand jury. The Fifth Amendment protects individuals from being forced to testify against themselves in court. In a common procedure intended to coerce testimony, the judge in the case granted Steve immunity, meaning that he could no longer be charged with crimes associated with his testimony. In so doing, the judge created the conditions by which Steve could be forced to testify or jailed if he refused to do so. Perpetual chaos keeps everyone so off balance that news of the navy confirming the existence of UFOs, youth around the world demanding those in power address a global environmental crisis, and workers from Appalachia to Detroit blockading to force greedy bosses to come off a little of their profits all slide by in a cycle or two. Impeachment? That’s last week’s news. Protests against authoritarianism in Hong Kong? Was that even this year? It’s enough to make one throw up their hands and ask whether or not anything can be done. NYC ABC  is here to tell you that there is plenty to get done and that it doesn’t have to overwhelm you. Focus on something that might seem small, like writing a letter to a political prisoner or prisoner of war, make a connection to someone who has been pulled from a community of resistance, and build from there. We help to make those connections with our every-other-week political prisoner letter-writing dinners and this week we focus on Jeremy Hammond, currently jailed for resisting a grand jury, while also serving a federal prison sentence for “hacktivism.”

Jeremy Hammond is an anarchist computer hacker from Chicago. In November 2013, he was sentenced to 10 years in federal prison for leaking the personal information of 860,000 customers of private intelligence firm Strategic Forecasting (Stratfor) through the whistle-blowing website Wikileaks. This information revealed that Stratfor spies on activists, among others, at the behest of corporations and the U.S. government. In early September 2019, Jeremy was transferred to Virginia and called against his will to appear before a grand jury. Jeremy is now jailed at the same spot as Chelsea Manning, who is also being held for grand jury resistance. Hey, everybody, jump in the car–we’re going on a road trip. Really? No. However, we are doing something fun and while we might not be heading cross country, the letters we write and mail at this weeks’ political prisoner letter-writing dinner are going all the way to…VIRGINIA. That’s because this week, NYC ABC is focusing our every-other-week event on Chelsea Manning, being jailed, in solitary confinement, for being principled in her resistance to a secretive federal grand jury.

Chelsea Manning, an anti-secrecy activist and former U.S. Army intelligence analyst whose release of classified information to WikiLeaks in 2010 sparked worldwide controversy over transparency in the military and whistleblower protections, was taken into custody at a federal court after a federal judge found her in contempt of court for refusing to answer questions before a secret grand jury. Hot on the heals of NYC ABC‘s recent letter-writing dinner for water protectors held captive by the state, we are excited to host an event to help not only water protectors but all folks engaged in revolutionary struggle.

NoDAPL water protectors and the Water Protector Anti-Repression Crew are facilitating trainings across Turtle Island sharing knowledge about resistance to the grand jury convened against water protectors at Standing Rock. They want to build capacity for strong movement defense against state repression.

Strong movements and interdependent relationships make attempts to shut down our struggle obsolete. Let’s build our capacity for defending our movements together!

This two-hour workshop is open to all who have participated in the movement at Standing Rock, those who have supported the efforts on the ground from their homes and territories elsewhere, as well as all those who wish to continue fighting on the many frontlines that continue to emerge across Turtle Island.

The fight isn’t over at Standing Rock, as nearly 800 Water Protectors continue their battles in the courtrooms with some facing federal felony indictments that carry a potential of 15 years in federal prison. The grand jury convened against water protectors continues as does the resistance to it. As extraction becomes the norm and the government ramps up its repression against those who stand in resistance, this workshop holds valuable information for those who struggle for Indigenous sovereignty, earth liberation and a future without oppression.

As the year is coming to an end we are left with much to reflect on. The ongoing battle at Standing Rock from indigenous folks and their allies against those who would take away their land and water has been an intense continuing inspiration of resistance. These defenders of water have faced serious repression from the State and private security forces since the beginning of this struggle with mass arrests, continuing harrasment, and physical attacks, including the recent assault on local #NoDAPL supporter Sophia Wilansky who nearly lost her greatly injured arm to an explosive deployed by local cops while she was assisting those on the front lines. This week we will be writing to Red Fawn Fallis, an Oglala Lakota Sioux water protector who is currently facing federal firearms charges.

On October 27th, Red Fawn and over 140 other water protectors were arrested on the front lines of Standing Rock during a massive police raid on a camp of resisters. Red Fawn was initially accused of firing on local cops while being arrested and charged with attempted murder but those charges have since been dropped and Red Fawn was then transferred into federal custody to face federal charges of possessing a firearm while being a felon. Red Fawn has been steadfast in her dedication to the struggle by putting her body on the line despite the endless attacks of the local cops and private security hired by the pipeline company and being arrested on two other occasions during her stay.

We encourage everyone who writes to Red Fawn to keep in mind that she is still facing trial and to be extra cautious in writing to her. As always, do not write anything sketchy or illegal as it will put Red Fawn in a worse situation as her mail is likely being monitored. For that reason, you should also not mention the charges she facing or the actions she is accused of, as any communication of that sort can only serve the State and their case and harm Red Fawn. Do not let this dissuade you from writing to Red Fawn as she can use all of the support that she can get right now. It is also with great heaviness in our hearts that we remember NYC resident and comrade Clark Fitzgerald who passed away while traveling to the front lines of Standing Rock in order to assist the resistance.

There is also a federal grand jury that is ongoing in relation to #NoDAPL. Always remember that if you are subpoenaed or approached by law enforcement in this and in any circumstance that you should not answer any of their questions and that you should immediately contact a lawyer. If you have been contacted by law enforcement or subpoenaed specifically in relation to the Standing Rock resistance, contact the Water Protector Legal Collective in order to protect yourself and your comrades.

Grand Jury Resister Jerry Koch is Free!

On Tuesday, January 28th, anarchist grand jury resister Gerald “Jerry” Koch was released from the federal Metropolitan Correctional Center in Manhattan. Koch’s release comes over eight months after his imprisonment for refusing to testify before a grand jury convened under the auspices of investigating the so-called bicycle bomber case.

Judge John Keenan, the presiding judge over Jerry’s case, believes that taking the position of a government run amok, using grand juries as a witch hunt is, “a delusion of grandeur.” Judge Keenan goes on:

There is simply no evidence that the Government [sic], threatened by Koch’s subversive prowess, seeks to bring him before the grand jury on a pretext, either to gain access to the treasure trove that is his circle of friends or to send an ominous message to political dissidents.

In reality, the United States government was following a pattern of using grand juries as fishing expeditions in hopes of better understanding social and political networks of anarchists. This tactic has been recently seen in the Pacific Northwest and in California. Regardless, Jerry’s release does not come as a result of some hacky judge “seeing the light” and letting the barred door swing wide. It comes due to the diligence of his legal support in filing a strong Grumbles motion. Also from the judge’s decision:

Koch’s argument is straightforward. Because he continues to oppose the government in general and the grand jury process in particular, he urges that continued confinement will not induce him to testify. Indeed, he asserts that his tenure at the MCC has caused his views about government repression to congeal even further.

Imprisonment for civil contempt in order to coerce someone to testify is, according to the state, not supposed to be punitive. When it becomes punitive and loses any coercive power, the individual must be released (or so goes the argument). The content of the motion filed by Jerry’s legal support argues that the function of Jerry’s imprisonment—to coerce him to testify before the grand jury, was failing and in fact had become merely punitive. Based on the above quote, judge Keenan agreed. And this is the basis of the judge’s decision to release Jerry.

Judge Keenan’s decision also reveals the importance of outside support. Articles written about Jerry, letters written on his behalf, and even an online petition cumulatively added to the strength of the motion filed on his behalf. Strong solidarity from family and friends positively contributed to Jerry’s release.

In reading Judge Keenan’s decision, it is clear that the only joy he is able to squeeze out of his miserable life is in sophomoric barbs launched at Jerry and anarchists in general. And at the end of the day, none of the judge’s childish insults matter. What matters is that we have our comrade returned to us, unbroken.

Again in the words of Judge Keenan, Jerry “has chosen to remain in contempt– indeed he promises continued and endless contempt.” And for that, we applaud you, Jerry. Welcome home.

With grand jury resistance here in NYC, Feds sneaking around in Southern California, and other campaigns & projects across the country, anarchists have their hands full. The work that’s happening on these projects is, in many ways, inspiring. With that inspiration, there are plenty of reasons to become directly involved. It is in the spirit of direct involvement (and the magick of Halloween) that we host another Political Prisoner Letter-Writing Dinner. And what could be more ghoulish than the Green Scare?

Since the early 1980s, public relations hacks have been working to reify the term “eco-terrorism.” By 2004, they became successful and a phrase that a decade earlier had no real meaning was now defined by the United States government and used to introduce legislation. Now we have comrades serving decades for economic sabotage and allegations of thought crime. With several recent animal liberation actions, and Rebecca Rubin facing 5 to seven and a half years, it is clear that Earth and animal liberationists are both still active and still in the cross-hairs of the feds. Join us in letting them know they are not forgotten.

First Prison Statement from Jerry Koch

Jerry’s first statement from inside:

First and foremost, I want to thank everyone who has supported me in so many ways these past three months. It has been a hell of a ride thus far, full of sudden transfers and inexplicable delays. In the face of all that, I’m doing all right, although I’d like to see the sun more and truly miss the color green. I miss my friends and my loved ones, and I’m looking forward to the day when I can finally rejoin you all in the land of the living. But I am holding strong. I do not know how much longer the State plans to keep me separated from my family and friends, but I will not bend.

Compared to the vast majority in this prison, I’m lucky. I’m not facing the very real possibility of spending the rest of my life in this place, as so many of the men in my unit are. I am really fortunate to have such strong support on the outside. The solidarity everyone has shown is helping me through this and constantly reaffirms my resolve.

The Federal Grand Jury that put me here is only the most recent facet of an assault on those who wish to be free of state surveillance and intimidation. This legal onslaught has already targeted and claimed the freedom of many anarchists, but we will keep fighting. I will keep fighting. My politics, principles and ethics stand in direct opposition with this legal tool that is used to further enable the government in its assault on anarchists, and I will not lend it any legitimacy, nor will I comply in any way.

Thank you again to everyone for your truly beautiful acts of support. Your letters especially are helping me get through this, and I look forward to talking with many of you soon, on this side of the bars and beyond.
